Rubbish Removal Hampstead Terms and Conditions

These Terms and Conditions set out the basis on which Rubbish Removal Hampstead provides rubbish removal and related waste collection services. By making a booking, confirming a quotation, or allowing our team to commence work at your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given:

1.1 "Company" means Rubbish Removal Hampstead, the provider of the waste removal services.

1.2 "Customer" means any individual, business, landlord, agent or organisation that requests or receives services from the Company.

1.3 "Services" means rubbish removal, waste collection, clearance, loading, transportation and disposal, and any related services offered by the Company.

1.4 "Waste" means household, commercial or other non-hazardous waste that the Company agrees to collect and dispose of in accordance with applicable regulations.

1.5 "Site" or "Premises" means the location from which the Company is requested to remove Waste.

1.6 "Contract" means the agreement between the Company and the Customer, formed in accordance with these Terms and Conditions.

2. Scope of Services

2.1 The Company provides rubbish removal and waste collection services within its designated service areas. The specific services, including the type and volume of Waste to be collected, will be agreed at the time of booking or quotation.

2.2 The Company will use reasonable care and skill in providing the Services and will endeavour to carry out collections at the agreed date and time, subject to clause 8 below.

2.3 The Services do not include the removal of any items which are illegal to carry, store, transport or dispose of, or any materials classed as hazardous or requiring specialist handling, unless expressly agreed in writing in advance and permitted by law.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any booking system operated by the Company. The Customer must provide accurate and complete information, including:

(a) the address of the Premises and access details;
(b) a description and approximate volume or weight of the Waste;
(c) any items requiring special handling;
(d) preferred date and time for collection; and
(e) contact details for the person responsible on the day of the collection.

3.2 Any quotation provided by the Company is based on the information supplied by the Customer. The Company reserves the right to amend the quotation and applicable charges if the information provided is incomplete, inaccurate, or if the Waste presented on arrival differs materially from that described at the time of booking.

3.3 A Contract is formed when the Customer accepts a quotation or booking confirmation provided by the Company, or when the Company commences the Services at the Premises with the Customer’s consent.

3.4 The Customer confirms that they are the owner of the Waste or are otherwise authorised to arrange for its removal and disposal.

4. Access and Customer Responsibilities

4.1 The Customer must ensure that the Company has safe, clear and reasonable access to the Premises at the agreed time. This includes providing any necessary keys, access codes, parking permissions or permits, and ensuring that any access routes are free of obstruction.

4.2 The Customer must ensure that the Waste is presented in a safe condition for removal. Sharp, heavy or awkward items must be disclosed at the time of booking, and the Customer must advise the Company of any risks or hazards at the Premises.

4.3 The Customer is responsible for obtaining any consents, permissions or approvals required for the Company to carry out the Services, including building management approvals, landlord consents or local parking arrangements.

4.4 If access is not available or is unsafe when the Company arrives, the Company may, at its discretion, cancel the visit or wait until the issue is resolved. Waiting time or aborted visits may be charged in accordance with the Company’s current price structure.

5. Pricing and Payments

5.1 Prices are generally based on the volume, weight and nature of the Waste, along with access conditions, parking charges and any additional labour or time required. The Company will provide an estimate based on the Customer’s description and will confirm the final charge once the Waste has been inspected on site.

5.2 All prices are quoted in pounds sterling. The quotation will state whether it is inclusive or exclusive of any applicable value added tax or other taxes.

5.3 Payment is due on completion of the Services, unless otherwise agreed in writing in advance. The Company may, at its discretion, require full or partial payment in advance, particularly for large collections, commercial clients or repeat bookings.

5.4 Payment may be made by cash, bank transfer, card payment or any other method accepted by the Company at the time of booking. Commercial customers may request an account facility, which will be subject to separate credit terms.

5.5 If payment is not received when due, the Company reserves the right to charge interest on the overdue amount at the statutory rate permitted under UK law, accruing daily until payment is received in full. The Customer will also be liable for any reasonable costs incurred by the Company in pursuing recovery of outstanding sums.

6. Cancellations, Rescheduling and Waiting Time

6.1 The Customer may cancel or reschedule a booking by giving reasonable notice to the Company. The Company asks that customers provide at least 24 hours notice where possible so that slots can be reallocated.

6.2 The Company reserves the right to charge a cancellation fee if a booking is cancelled or rescheduled at short notice, particularly where a crew has already been dispatched, where vehicle and labour have been allocated, or where the Company has incurred costs in preparation for the booking.

6.3 If the Company arrives at the Premises and is unable to complete the collection due to the Customer’s failure to provide access, provide the Waste, or ensure safe working conditions, the Company may treat the visit as an aborted collection and charge a call-out or minimum fee.

6.4 The Company will use reasonable efforts to arrive within agreed time windows but cannot guarantee exact arrival times, which may be affected by traffic, weather, road closures, or other factors beyond its control. Where delays occur, the Company will inform the Customer as soon as reasonably practicable.

7. Waste Types and Excluded Materials

7.1 The Company collects most forms of non-hazardous household and commercial Waste, such as general rubbish, furniture, appliances, garden waste and similar materials.

7.2 The following materials are excluded unless expressly agreed in writing and permitted by applicable regulations: hazardous waste, clinical or medical waste, asbestos, certain chemicals or solvents, gas bottles, explosives, pressurised containers, and any materials requiring specialist licensing or disposal routes.

7.3 If excluded materials are discovered among the Waste, the Company may refuse to remove them, may adjust the charge to reflect additional handling requirements, or may terminate the Contract. Any costs, fines or penalties arising from undeclared hazardous or prohibited materials will be the responsibility of the Customer.

8. Service Delivery and Limitations

8.1 The Company will provide appropriate vehicles, equipment and personnel to carry out the Services safely and efficiently, subject to reasonable site conditions.

8.2 The Company may decline to remove any item that, in the opinion of its staff, is unsafe to handle, excessively heavy, structurally unsound, contaminated, or otherwise likely to cause injury, damage or breach of regulations.

8.3 The Company is not responsible for cleaning, sweeping or repairing surfaces beyond what is reasonably incidental to the removal of Waste. Any additional cleaning or reinstatement will only be carried out if expressly agreed and may be subject to further charges.

8.4 If the Company is prevented or delayed from performing the Services due to events beyond its reasonable control, including but not limited to severe weather, accidents, vehicle breakdowns, public events, strikes or emergencies, it will not be liable for any resulting loss or damage. In such cases, the Company may reschedule the Services without additional charge to the Customer.

9. Liability and Damage

9.1 The Company will take reasonable care to avoid damage to property when carrying out the Services. However, the Customer acknowledges that in some cases, removal of large, fixed or awkward items may involve a risk of minor damage to decorations, fixtures or fittings.

9.2 The Customer should move or protect any fragile items, valuables, floor coverings or surfaces that may be susceptible to damage during the course of the Services. The Company cannot be held responsible for damage to items that were not removed from the working area or adequately protected.

9.3 The Company’s total liability for any loss or damage arising from the provision of the Services, whether in contract, tort or otherwise, shall be limited to the amount paid or payable by the Customer for the specific job to which the claim relates, except where liability cannot legally be limited or excluded.

9.4 The Company shall not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the Services.

9.5 Nothing in these Terms and Conditions limits or excludes the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded by law.

10. Compliance with Waste Regulations

10.1 The Company is committed to lawful and responsible waste management. All Waste collected will be transported and disposed of through authorised facilities in accordance with applicable UK waste legislation and environmental regulations.

10.2 The Customer acknowledges that once Waste is collected by the Company, it becomes the Company’s responsibility to handle and dispose of it in compliance with waste regulations. The Customer agrees not to request or encourage any unlawful disposal or fly-tipping.

10.3 Where required, the Company will issue appropriate documentation or receipts confirming the collection of Waste. Commercial customers may be required to provide additional information or documentation to comply with duty of care obligations under waste regulations.

10.4 The Customer shall provide honest and accurate information about the nature of the Waste. Any penalties, fines or additional costs incurred due to misdescription or concealment of hazardous or regulated materials will be the responsibility of the Customer.

11. Customer Data and Communication

11.1 The Company will use the Customer’s contact details for the purpose of managing bookings, providing the Services, issuing invoices and receipts, and dealing with any queries or complaints.

11.2 The Company may retain records of jobs carried out, including the type and approximate volume of Waste collected, for operational, legal and accounting purposes.

11.3 The Customer agrees that the Company may contact them by telephone, email or other agreed method in relation to current or future bookings, subject to any applicable data protection and marketing laws.

12. Complaints and Disputes

12.1 If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, and in any event within a reasonable time after completion of the job. The Company will investigate and, where appropriate, seek to resolve the issue through repair, re-service, partial refund or other suitable remedy.

12.2 The Customer should provide any relevant evidence or information to assist the Company in assessing the complaint, including photographs, descriptions of any alleged damage, and details of the crew and date of service.

12.3 The Company aims to resolve complaints amicably. If a dispute cannot be resolved directly, both parties agree to consider negotiation or mediation before resorting to formal legal proceedings, where appropriate.

13. Variations and Severability

13.1 The Company reserves the right to amend these Terms and Conditions from time to time. The version in force at the time of the Customer’s booking will apply to that Contract.

13.2 Any variation to these Terms and Conditions must be agreed in writing and signed or otherwise clearly confirmed by an authorised representative of the Company.

13.3 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the Contract or these Terms and Conditions.

By confirming a booking or allowing Rubbish Removal Hampstead to commence work at your premises, you acknowledge that you have read, understood and agree to these Terms and Conditions.
